When Chipotle was originally sued, they were vilified by all the major mainstream media players. Now that the suit has been dismissed, those same outlets are COMPLETELY SILENT.
While Chipotle Mexican Grill is far from perfect, the chain’s commitment to going non-GMO gave it a special place in the hearts and minds of millions.
At a time when most restaurants are simply going along with Monsanto and other chemical and Biotech companies’ visions of a mostly lab-engineered, glyphosate soaked food system, Chipotle listened to customer demand and finally gave customers their first mainstream non-GMO option.
Consumers rewarded them for their landmark non-GMO stance, but some people weren’t satisfied, including Colleen Gallagher of California, who filed a class-action lawsuit in fall 2015 saying that Chipotle was deceptive about their non-GMO claims.
The mainstream media, eager to push their own ongoing narrative in favor of GMOs, ate it up:
Gallagher’s lawsuit made major headlines in news organizations ranging from NPR to Newsweek to Fox and NBC News. In fact, the hundreds of mainstream sources for the original suit still come up first in Google News searches.
Just a few short months later, however, the lawsuit has officially been dismissed: and the mainstream media has completely ignored it.
Case Dismissed; But Chipotle Still Has Work to Do
The lawsuit was quietly dismissed in early February as a judge said that Gallagher did not “specify that she purchased food in the “GM” categories (i.e., meat, dairy, or soft drinks) and thus failed to connect economic injury to the allegedly deceptive claims. She also did not specify that she would return to Chipotle; therefore any ruling would not benefit her.
Although Gallagher was given the option to amend the complaint and re-file in the future, it is especially worth noting that these major media outlets did not report on the case being dismissed after make a huge ruckus about it when it was filed. Is that because it didn’t fit their narrative?
This article from The National Law Review hypothesizes that the court may have been “looking for additional support for the notion that reasonable consumers hold the same strict interpretation of non-GM claims..”
A Vermont labeling law that passed and other similar laws still don’t include meat and dairy and other non-direct sources of GMOs in their guidelines; therefore it should be reasonably assumed that this is the standard for judging whether a food contains GMOs or not in terms of U.S. labels in general. Soda, which is usually made from GMO corn, is also sourced from Coca Cola at Chipotle, further clouding the picture.
Of course, for the millions of people who prefer organic food and a phasing out of the influence of GMOs in the food supply this is not ideal; the vast majority of people want all non-GMO food whenever possible and aren’t fond of the widespread use of GMOs in animal feed and third-party beverages at restaurants.
Chipotle still has a ways to go in bringing their standards up to that level, but in a country where GMOs were foisted upon the population mostly in secret and without adequate long-term safety testing, Chipotle’s stance is an important milestone, and the media’s bias against it has been clear from day one.
Stay tuned for more as Chipotle continues to refine its menu and practices and America continues to fight for its right to transparency and GMO free options.
